Kratom is not federally scheduled, which makes people assume they can take it anywhere. They're wrong. 12 states have banned it, and crossing into one of those states with kratom — whether by car, plane, or mail — is a criminal offense.
As of 2026, kratom is illegal in: Alabama, Arkansas, Connecticut, Idaho, Indiana, Louisiana, Mississippi, Ohio, Rhode Island, South Dakota, Vermont, Wisconsin. It is restricted in: Delaware, Hawaii, Illinois, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, North Carolina, Utah, West Virginia. Possessing kratom in any of these states is a criminal offense regardless of where you purchased it.
Can You Fly With Kratom?
Kratom is not on the TSA's prohibited items list. It's not a federally controlled substance, so TSA agents are not specifically looking for it during screening. In practical terms, kratom powder in your carry-on or checked bag will usually pass through security without issue.
But that's only half the equation. The problem isn't the TSA checkpoint — it's what happens when you land. If your destination is a ban state, you're committing a crime the moment you step off the plane with kratom in your bag. If you have a layover in a ban state and your checked bag is searched, you could face charges in that state.
The safest approach: don't fly with kratom if any part of your itinerary — including layovers — passes through a ban state. If you're flying between two legal states with no ban-state layovers, the practical risk is low, but you should still keep kratom in its original labeled packaging.
Can You Drive Across State Lines With Kratom?
This is where most people get caught. Unlike firearms, which have federal safe-passage protection under FOPA, there is no federal law that protects you while transporting kratom through a ban state. If your route from Tennessee to Florida passes through Alabama, you are committing a crime in Alabama for every mile you drive with kratom in the car.
"I'm just passing through" is not a legal defense. "I bought it legally" is not a legal defense. "I didn't know it was illegal here" is not a legal defense. The law in the state you are physically in is the law that applies to you.
High-Risk Driving Corridors
Tennessee → Florida via Alabama
Alabama bans kratom. I-65 through Alabama is the most direct route from Nashville to the Gulf Coast. Kratom users driving this corridor need to route through Georgia instead.
Illinois → Tennessee via Indiana
Indiana has banned kratom. The I-65 corridor from Chicago to Nashville passes directly through Indiana. Route through Kentucky instead.
Missouri → Mississippi via Arkansas
Arkansas bans kratom. If you're heading south from Missouri, the I-55 corridor through Arkansas is a problem. Route through Tennessee.
Any Route Through Vermont or Rhode Island
Both states ban kratom. New England travelers need to be aware that these small states can be easy to accidentally drive through.
Can You Ship Kratom?
Shipping kratom to a legal state is generally fine. Most online vendors ship via USPS, UPS, or FedEx without issues. But shipping to a ban state is illegal — and you're the one who faces charges, not the vendor.
Some vendors have geo-blocks that prevent orders to ban-state addresses. Many don't. The fact that a vendor was willing to process your order and ship to your address does not make it legal to receive the package. If a package containing kratom is intercepted or inspected in a ban state, the recipient is the one who faces criminal liability.
Shipping kratom internationally adds another layer of complexity. Many countries ban kratom outright, and customs seizures can trigger investigations. Stick to domestic shipping between legal states.
