Delta-8 Penalties: What Happens If You Get Caught in a Ban State
Delta-8 THC sits in a legal gray zone. Federally, it's arguably legal under the Farm Bill. But 12 states have banned it, and in those states, the penalties are real. Here's what you actually face.
The Field Test Problem
Standard roadside drug tests cannot tell delta-8 apart from delta-9 THC. If an officer finds a vape cartridge or gummy in a ban state, the field test will likely come back positive for THC. You'll be arrested and charged with marijuana possession. Lab results that confirm it's delta-8 may eventually help your case, but the arrest, booking, and initial charges happen regardless. You'll need a lawyer to argue the distinction, and that costs money even if the charges are eventually reduced.
